Reckless Operation of a Motor Vehicle

A person operates a vehicle recklessly when they, upon any way, drive recklessly, or in such a manner that the lives and safety of the public are endangered.

The operator of the vehicle must be operating a vehicle in such a manner to show willful or reckless disregard of his/her consequences.

The Prosecutor must show the operator's mental state of recklessness and show that the defendant was aware of their conduct and that it constituted an unjustifiable risk of some forbidden harm (which may include some harm) but consciously disregarded those risks.

The penalties for Reckless Operation include a fine of not less than $250.00, nor more than $1000.00, as well as a license revocation for not less than 60 days for a first offense, and 60 days to one year for a second an/or subsequent offense.
